Tilson Tracker Day 222
Major Progress as City of Las Vegas Issues Default Notice to Gigapower
A Turning Point in the Gigapower Saga
On January 15, 2025, the City of Las Vegas officially issued a Notice of Default to Gigapower, LLC, marking a significant development in the ongoing battle over the disruptive fiber installation project. This action represents a major win for the neighborhoods that have endured nearly 250 days of blocked sidewalks, damaged streets, and unsafe conditions caused by Tilson and Gigapower's mismanagement.
Why Is Gigapower in Default?
The City’s investigation, supported by extensive neighborhood complaints and permit violations, uncovered numerous breaches of the Franchise Agreement signed with Gigapower in April 2023. Key issues include:
Failure to Complete Restoration Work: Gigapower failed to meet the required 24-hour restoration timeline after excavation, leaving roads and sidewalks in disrepair.
Multiple Traffic Control Violations: Ongoing infractions in traffic barricade setups created public safety hazards.
Unsafe Construction Practices: Reports include Tilson vehicles running stop signs, flaggers not paying attention, homes being blocked without notice, and illegal towing of cars.
Damage to Private Property: Sewer lines, sidewalks, and driveways have been significantly damaged, with uneven patches and hazardous road conditions left behind.
The City cited these issues as creating “significant and unreasonable disruption” and “a public safety risk.”
What Is the City Doing About It?
The City has taken strong action to hold Gigapower accountable:
Suspension of Permits: All non-restoration permits related to the Gigapower project are now suspended.
Permit Freeze: No new permits will be issued until Gigapower agrees to an updated, expedited restoration schedule and demonstrates compliance.
Restoration Plan Requirement: Gigapower must submit a detailed restoration plan by January 27, 2025, and promptly implement it.
Neighborhood Meetings: The City is requiring Gigapower to hold neighborhood meetings to address resident concerns before any future construction is permitted.
What Happens If Gigapower Doesn’t Comply?
If Gigapower fails to meet the conditions outlined in the Notice of Default, the City is prepared to:
Terminate the Franchise Agreement with Gigapower.
Pursue liquidated damages and other legal remedies.
Community Advocacy Makes the Difference
The City specifically acknowledged neighborhood efforts in bringing these issues to light, including:
The creation of Tilson.Vegas to document construction failures.
Attendance and testimony at City Council meetings by residents.
This proves that community advocacy matters. The collective voice of frustrated residents has pushed the City to take action against Gigapower and its contractors.
